Whenever we use “we”, “us” or “our”, we mean the Company. When we use “you” or “your,” we’re talking to you, the person using our services.

JOINING OAK & POPPY LOYALTY PROGRAMME
You can join the Oak & Poppy Loyalty Programme for free by downloading our app from the Google Play Store or Apple App Store and signing up for an account.

HOW TO EARN POINTS AND REWARDS
​
Earn 5 points for every £10 spent at Oak & Poppy. Once you accumulate 50 points, you'll receive a £5 reward voucher to enjoy on your next visit. To prevent fraud, points will not be awarded for transactions made within 15min of a previous point-earning transaction. Ensure you show your QR code at checkout to earn points.
Orders made through delivery partners and non-food items (e.g., gift cards or service fees) do not count towards point accumulation.
Points and rewards are personal to each loyalty account and cannot be combined or transferred. If you hold multiple accounts, points and rewards cannot be merged.

CHECKING YOUR LOYALTY BALANCE
You can see your account balance on your wallet card.
We reserve the right to correct your account balance if necessary. If you wish to dispute a correction, please contact us.

REDEEMING REWARDS
Rewards are available immediately upon earning and ready to use on your next visit.
Rewards can be redeemed at Oak & Poppy restaurant by scanning your wallet pass. Rewards have no cash alternative.

LIMITATIONS OF USE
We don’t warrant or represent that the Oak & Poppy Loyalty Programme will always be accepted at participating Oak & Poppy locations. For example, in the unlikely event of a failure of our IT and communications systems, we may not be able to add stamps or allow you to redeem a reward during such a system failure.
We can withdraw or cancel your Oak & Poppy Loyalty Programme account or take any other appropriate action if we suspect fraud, misconduct, or unauthorised use. Once cancelled, you won’t be able to redeem any stored rewards.

CANCELLATION OR WITHDRAWAL
We reserve the right to withdraw the programme with reasonable notice. We’ll notify you via the email linked to your account.
You may cancel your account at any time but will lose unused rewards. Contact us to cancel.

OUR LIABILITY
Nothing in these Terms excludes or limits our liability for:

death or personal injury caused by our negligence;

fraud or fraudulent misrepresentation;

and any matter in respect of which it would be unlawful for us to exclude or restrict our liability.
Subject to clauses 10.1 and 10.3, our maximum liability to you in relation to your use of any Oak & Poppy Loyalty Programme account shall not exceed the outstanding balance of rewards held on your Oak & Poppy Loyalty Programme account.
We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time that you used your Oak & Poppy Loyalty Programme account.
We only provide the Oak & Poppy Loyalty Programme account for domestic and private use. You agree not to use the Oak & Poppy Loyalty Programme account for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
Nothing in these Terms affects your statutory rights. Advice about your statutory rights is available from your local Citizens’ Advice Bureau or Trading Standards Office.

SUSPENSION AND TERMINATION
Breach of these terms may result in:

A warning,
-
Temporary or permanent account suspension,

Legal action for incurred costs,

Disclosure to law enforcement.

CHANGES TO TERMS
We may make changes to these Terms from time to time (if, for example, there is a change in the law that means we need to change these Terms). Please check these Terms regularly to ensure that you understand the Terms that apply at the time that you use the Oak & Poppy Loyalty Programme account. If you have registered your Oak & Poppy Loyalty Programme account, we will provide you with at least thirty days’ advance notice of any changes to the Terms, unless such changes are required on shorter notice to comply with applicable law. If you do not agree to the changes, you have the right to cancel your Oak & Poppy Loyalty Programme account at any time, but you will lose the right to redeem all unused rewards. If you wish to cancel your account, you must contact us.

OTHER INFORMATION
Each clause operates independently. Unenforceable clauses will not affect the remaining terms.
Failure to enforce these terms does not constitute a waiver.

GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales. This means that your use of your Oak & Poppy Loyalty Programme account and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims), will be governed by English law. Nothing in these Terms, including this clause, affects your rights as a consumer to rely on such mandatory provisions of local law.
If you are a consumer, you may bring any dispute which may arise under these Terms to – at your discretion – either the competent court of England. We shall bring any dispute which may arise under these Terms to the competent court of England.
